This report, titled "Report 9/2024," is part of our ongoing efforts to improve how county governors handle cases involving coercion and force under Chapter 9 of the Health and Care Services Act. It focuses on the role of county governors as supervisors in cases where coercion and force are used on individuals with intellectual disabilities.
The report highlights several challenges in how county governors review these decisions. This work is part of the "Coercion and Force" project started by the Norwegian Board of Health Supervision in 2023, aiming to enhance the quality of supervision and decision-making in these cases.
We evaluated how county governors review decisions involving coercion and force and explored ways to improve legal protection for individuals with intellectual disabilities. The report offers recommendations for improvements, including updating guidelines for county governors, continuing regular forums and courses on coercion and force, collecting useful information on the Losen intranet, and creating a standard template for reviewing decisions.
The review found significant differences in how county governors handle these cases, and we need to address these inconsistencies. The report also stresses the importance of ensuring that county governors have enough resources to effectively review decisions.
